There was no Sunday driving for Kurt Busch.

The NASCAR driver lost the appeal of his suspension on Saturday night ending his hopes in participating in the season-opening Daytona 500.

The suspension is indefinite.

Busch was suspended after a Delaware judge found that the 2004 champion almost certainly choked and beat his former girlfriend last fall at the Dover International Speedway.

The three judge panel denied his appeal on Saturday night and that was followed by a final denial by Gulfstream President Bryan Moss.

Busch’s attorney, Rusty Hardin, said that while his client was disappointed in the latest decision Busch would pursue every procedural and legal remedy available.
