DOVER, Del. (AP) - A federal judge has refused to issue an injunction sought by struggling all-girls charter school in New Castle trying to stave off a second state-ordered closure.
The judge ruled Monday that attorneys for Reach Academy have not shown that they are likely to succeed on any legal claims against the Delaware Department of Education and are therefore not entitled to a preliminary injunction.
The judge also noted that state law has changed since he issued an injunction last year keeping Reach remain open for one year, and that another all-girls school could be approved if Reach Academy closes.
Reach supporters say students at the predominantly black school are victims of gender and racial discrimination, and that DOE officials violated the students' due process rights in moving to close the school.
