A Delaware Superior Court judge has blocked expansion of the Delaware City Refinery’s biofuel operations – at least for the moment.

Judge Diane Streett ruled in favor of two civic groups saying that a state board erred in rejecting their appeal of a state permit that allowed the project to move ahead.

The Wilmington News Journal reports that the Delaware Audubon Society and the Delaware League of Women Voters claimed that the permit violated the Coastal Zone Act.

The board will now have to reconsider whether the group have legal standing to bring the appeal.

DOVER, Del. (AP) - A state panel has voted to dismiss an appeal by environmental groups of a permit granted by Delaware regulators for a new crude oil transfer operation at the Delaware City refinery.

Members of Delaware's Coastal Zone Industrial Control Board voted unanimously Tuesday afternoon to dismiss the appeal by the Sierra Club and the Delaware Audubon Society, ruling that they had no standing to challenge an air quality permit granted to PBF Energy in May.
