ANNAPOLIS, Md. (AP) - A Naval Academy spokesman says an investigative officer who presided over a hearing involving three midshipmen in an alleged sexual assault case has forwarded his recommendations to the academy's superintendent.
Cmdr. John Schofield, the academy spokesman, confirmed Monday the report has been sent to the academy. Vice Adm. Michael Miller, the superintendent, is currently the commanding authority assigned to decide whether the case will proceed to a court-marital.
Schofield says Miller will not make a decision at this time due to a pending federal lawsuit. An attorney for the alleged victim, who is an academy student, is suing in an effort to force the superintendent to recuse himself from the case.
Schofield says the report is part of an ongoing investigation and could not be made public by the academy.
