PBF Wants Dismissal of Environmentalist Challenge at Delaware City Refinery

PBF Energy is calling for the dismissal of federal legal challenges by environmental groups against the delivery of crude oil and its transfer operations at its Delaware City Refinery.

The company says that state and federal interstate commerce laws bar the claims from Delaware Audubon and the Sierra Club Delaware chapter.

PBF Energy says that it secured state approval in May for air pollution control modifications at a barge-loading area for a new offloading train complex.

The Wilmington News Journal reports that the environmental groups argue the activities at the barge violated a ban on new bulk loading within the protected Coastal Zone.

A court hearing is set for July 16th.
