In a setback for the Wilmington Housing Atuhority the National Rifle Association has gotten the U.S. Third Circuit Court of Appeals to send a restrictions on guns in public housing back to Delaware for a ruling by the state Supreme Court .
The three judge panel has asked the high court decide whether the Authority can…under the Delaware State constitution to limit the possession of firearms in its buildings and can require residents to provide copies of their license to own and carry a firearm, including one that is concealed.
The two residents challenging the restrictions argue that the Delaware state constitution more broadly protects gun owner’s rights than the U.S. constitution.
A lower federal court had ruled that the authority was within its rights.
The state Supreme Court is set to take up the question of the law on Tuesday.
