There will be no charges against any guards in the wake of the death of inmate Ronald Shoup at Sussex County Institution.
This comes despite the autopsy that ruled his death a homicide.
The decision announced by the Delaware Attorney General’s office said there were a number of reasons including a reasonable defense for correctional officers.
In addition, the Wilmington News Journal reports the state’s top law office said it was not possible to prove whether the injuries were the product of intent, recklessness or negligence.
The death occurred when a quick response team rushed into Shoup’s cell and then crushed him while trying to restrain him.
The attorney for the Shoup family told the News Journal that the decision was not a surprise and that a civil suit would be forthcoming.
