A federal lawsuit is set to be filed against former Governors Ruth Anne Minner and Jack Markel and senior prison staff in the wake of an inmate uprising.

And a news conference is scheduled by the widow Lt. Steve Floyd who was killed along with two surviving officers at the James T. Vaughn Correctional Center.

The Wilmington News Journal reports that the attorneys for the two surviving corrections officers said Floyd was beaten by a number of inmates at the beginning of the uprising.

They said he was thrown into a closet and could be heard moaning adding after that they did not hear from him again.

Attorney Thomas Neuberger sent a letter to Governor John Carney last month charging that his predecessors had broken the prison system and that Carney needed to fix it.
