DOVER, Del. (AP) - A Delaware judge has rejected a Lewes resident's effort to halt construction of a road near a wind turbine at the University of Delaware's Lewes campus.
Gerald Lechliter filed a lawsuit last year challenging erection of the wind turbine on what he say was supposed to be open space land.
Lechliter argued this week that a road being built in the area lies within a "fall zone" surrounding the turbine, posing a potential safety risk if the 410-foot-high tower should topple.
Following a hearing Monday, a Chancery Court judge ruled Tuesday that Lechliter had not shown he would suffer irreparable harm if the road is built. The judge said the chancery case remains on hold pending a ruling on defense motions to dismiss a similar federal lawsuit filed by Lechliter.
