A federal grand jury has indicted 73-year old Joseph Capano Sr. for illegally running electric and gas lines through wetlands at the troubled Riverbend residential community off Delaware Route 9.

The allegations include lying to the Army Corps of Engineers about the substance and time of the water line work and providing an affidavit that falsely claimed the water line went in before a federal cease and desist order in 2009.

Capano could get up to five years in prison for each of the three counts for making false statements and three years for violating the Clean Water  Act.
