DOVER, Del. (AP) - Delaware's Supreme Court is weighing whether to overturn a judge's order transferring a former death row inmate who is awaiting retrial from maximum security to the general prison population.
The judge ordered Isaiah McCoy transferred last year after his lawyer said McCoy was being denied access to the law library and was unable to meet privately with his lawyer outside the presence of prison guards.
An attorney for the Department of Correction argued Wednesday that the judge overstepped his authority, adding that McCoy has a history of disciplinary problems, some involving sexual misconduct, and represents a safety and security threat.
Prison officials have previously said they are willing to work with McCoy's lawyers to ensure they have proper accommodations when meeting with him.
