Delaware A.G. Distances Office From Lab Drug Testing Scandal

Delaware Attorney General Beau Biden is pushing back on claims by public defenders that the scandal plagued drug testing lab in the medical examiner’s office is an investigative arm of prosecutors.

The public defenders have filed 112 motions seeking to overturn more than 95-hundred drug conviction from the last three years as a result of thefts of drug evidence at the testing lab.

A Biden spokesman told the Wilmington News Journal that that the Medical Examiner’s office was an independent agency under the Department of Health and Social Services.

But Delaware Public Defender Brendan O’Neill told the paper he was not surprised the Attorney General’s office was distancing itself from the scandal.

O’Neill told the paper that the drug testing lab was part of the prosecution team similar to the police and therefore bears some responsibility for the misdeeds in the office.

The scandal has already resulted in the suspension of the Medical Examiner and another employee in the office.
