Allen Harim Wins a Legal Battle for Millsboro Chicken Plant

Allen Harim’s plans for a chicken processing plant in the Millsboro area just got a step closer.

The poultry company beat back a court challenge this month by a group of residents trying to overturn the decision by the Sussex County Board of Adjustments.

The arguments revolved around technical issues including whether the company had standing in applying for an exception it received from the board and whether there was sufficient public notice.

The Wilmington News Journal reports at the heart of the conflict was whether the Board ignored its responsibilities by failing to get opinions from the Environmental Protection Agency and the Center for the Inland bays.

Superior Court Judge Richard Stokes ruled that the board did not have to do so after is got opinions from such agencies as the Department of Natural Resources and Environmental Control as well as the Department of Transportation.
