ACLU Sues MD Corrections Over Inmate Death

WILMINGTON, Del. (AP) - The ACLU is suing the state prisons commissioner to get information about the death of an inmate hours after he arrived at a facility in Smyrna.

The group filed the suit this week in Chancery Court on behalf of Natalie Way, the inmate's mother.

Corrections officials say 26-year-old Jason Cunningham died April 16, 2014, at a hospital after he was in custody at the James T. Vaughn Correctional Center in Smyrna. Cunningham was being held in default of bail on charges that included theft and menacing.

Way says corrections officials told her Cunningham was put into a four-point restraint and in a cell. The suit says state lawyers refused to disclose records relating to Cunningham's death without a subpoena.

Corrections spokesman Jason Miller did not immediately return requests for comment.
